Acceptance of terms of service
By using the gpslogik.se site and/or GPS tracking software (collectively referred to as ”the Service”), you agree to be bound by these Terms of Service (the ”Agreement”).
General terms
We do not allow covert tracking. You may not use our service to track a person without his or her consent, or track an object without the permission of its owner.
You may not use the Service where such use is illegal. It is your responsibility to ensure that your intended use of GPS tracking does not violate local, state or federal laws.
GPS Logik’s GPS tracking software installed on a cell phone is intended to be used in conjunction with an unlimited data plan. You are warned that you may incur substantial data charges if you decide to use our service without an unlimited data plan. Under no circumstances shall GPS Logik be liable for any charges billed by your cell phone company. You should be aware that we make no guarantees about the reliability or continuity of our service. We reserve the right to pause or terminate your service, or delete your account and tracking data, at any time without notice. We will not be liable for any losses, either direct or indirect, that such service interruption or data loss may cause you. Use the service at your own risk. You may not send automated requests to GPS Logik , attempt to circumvent GPS Logik’s authentication measures, reverse engineer our software or protocols, and otherwise engage in activities that we deem damaging to our service. You may not profit from our service in any way without prior written authorizatrion fromGPS Logik AB. In particular, you are not allowed to distribute cell phones with preinstalled GPS Logik tracking software.
The tracking service and software are provided to the end users only. Creation of GPS Logik accounts or installation of GPS Logik software on behalf of other users is prohibited.
GPS Logik accounts are non-transferable.
Privacy policy
We take your privacy very seriously. Our privacy policy is available at privacy. By accepting the Terms of Service, you agree to be bound by our privacy policy.
Indemnification
You agree to indemnify and hold GPS Logik AB, its affiliates, officers and employees, harmless, including costs and attorneys’ fees, from any claim or demand made by any third party due to your use of the Service, your violation of the Terms of Service, and/or your violation of any other right of any person or entity.
Disclaimer
USE OF THIS SERVICE IS PROVIDED ”AS IS, WHERE IS,” AS AN ACCOMMODATION, AND WITHOUT WARRANTY OF ANY KIND, INCLUDING, WITHOUT LIMITATION, ANY WARRANTY OF TITLE, MERCHANTABILITY, OR FITNESS FOR A PARTICULAR PURPOSE. IN NO EVENT SHALL INSTAMAPPER LLC BE LIABLE FOR DAMAGES OF ANY KIND TO YOU FOR ANY DEFICIENCY, ERROR, OR INTERRUPTION IN THE SERVICE PROVIDED HEREUNDER. YOUR SOLE REMEDY IN THE EVENT OF ANY DEFICIENCY OR ERROR SHALL BE TO REQUEST THAT INSTAMAPPER LLC CORRECT THE MATTER OR INFORMATION PROVIDED OR, IF INSTAMAPPER LLC FAILS TO DO SO, TO DISCONTINUE USE OF THE SERVICE AT YOUR OPTION.
Changes to Terms of Service
GPS Logik AB may change this Agreement at any time for any reason by posting the modified Agreement on its website. Your continued use of the Service after a modified Agreement is posted shall be acceptance of the new Agreement. If you do not agree with the modified Agreement, you must stop using the Service.
Governing law
This Agreement shall be governed by the laws of the country of Sweden. Should a dispute arise, you agree that any legal proceedings against GPS Logik AB shall be initiated in a state or federal court located in Skövde, Sweden.
